Webinar Update: European Commission Strategy on the Digital Single Market

We recently held a webinar on the highly anticipated EU’s Digital Single Market Strategy, which was released on May 6th by the European Commission.

The objective of the strategy is to tear down the regulatory obstacles to doing business online, and it will pose potential major challenges as well as opportunities for almost every company doing business in the EU. According to the European Commission the reforms could add €415bn per year to the European economy. The strategy is built on three pillars:

  1. better access for consumers and businesses to digital goods and services across Europe;
  2. creating the right conditions and a level playing field for digital networks and innovative services to flourish;
  3. maximising the growth potential of the digital economy.

In this webinar, Ignasi Guardans, Brussels Partner and former member of the European Parliament, presented the strategy as a whole, with a focus on some of its most challenging aspects in areas such as media law and copyright reform in the European Union.

Etienne Drouard, Paris Partner and former public officer at the CNIL (French Data Protection Authority), presented the announced changes in the legal framework of e-commerce, data management and privacy.

Annette Mutschler-Siebert, Berlin Partner, presented the measures related to e-government, e-procurement and how they will impact businesses.

FCC Net Neutrality and Muni Broadband Orders Examined in Upcoming Webcast

The FCC’s recent net neutrality order, classifying broadband Internet access as a Title II common carrier offering, along with the FCC’s decision to preempt North Carolina and Tennessee state laws that placed limits on municipal broadband networks will be examined in a special live webcast on Broadband US TV on Friday, March 13th from 1pm-2:30pm (Eastern).

The webcast, entitled “FCC Takes Charge – Net Neutrality and Muni Broadband: New Title II Rules for Broadband Access and Preempting State Limits on Municipal Networks” will present details about the rulings, predictions on implementation and court challenges, and what these rulings are likely to portend for broadband in America over the next year and beyond.

Co-hosts Marty Stern of K&L Gates and Jim Baller of the Baller Herbst Law Group will be joined by two panels of prominent players and experts on both sides of these white hot issues.

Retransmission Consent Examined in Heated, Live Webcast Debate Among Broadcast, Cable, Programming, and Consumer Interests

A live webcast last week carried on Internet TV channel Broadband US TV examined all sides of the debate on whether rules governing the grant of retransmission consent by local broadcast stations to cable operators, DBS providers, and other multichannel video programming distributors (MVPDs), should be reformed.

Retransmission consent negotiations have become quite contentious in recent years, at times resulting in the temporary blackout of a local broadcast station in the face of an impasse between the MVPD and broadcaster.

The lively and, at times, raucous debate featured Toni Cook Bush of Skadden, Arps and John Hane of Pillsbury Winthrop Shaw Pittman for broadcasters, Ross Lieberman of the American Cable Association and Cristina Pauze of Time Warner Cable for cable operators, Gigi Sohn of Public Knowledge for consumer interests, and Richard Waysdorf, of Starz Entertainment for independent programmers. The program was moderated by Broadband US TV co-hosts Marty Stern of K&L Gates and Jim Baller of the Baller Herbst Law Group.

Every season, viewers and sports fans seem to get caught in the middle of disputes between broadcasters and cable and DBS providers over the terms of carriage of broadcast stations and affiliated programming. This program will examine the real issues underlying retransmission consent disputes and the economics and politics driving these issues.

This is an especially important question now, because thousands of carriage agreements will be up for renewal this year, as the FCC continues to examine these issues in an ongoing rulemaking proceeding.

Comcast/NBCU Joint Venture Telebriefing (3/29/11)

Tower Technology Panel to Address Tough Issues on Getting Broadband Wireless Sites Built

The Tower Technology Summit  at CTIA Wireless 2011 will feature a panel on on Wednesday, March 23 in Orlando entitled "Zoning/Permitting: Shifting the Paradigm to Cooperation." The panel will grapple with the tough issues behind 4G and wireless broadband deployment — the pressure of building out networks using pole attachments in rights of way and macro sites in the face of sophisticated and increasingly successful community resistance, including vocal opposition often based on fear of radio emissions.

K&L Gates partner Marty Stern will be one of the speakers on the panel and will discuss specific approaches from earlier deployment-related battles at the federal level. Marty will be focusing on strategic approaches to advocacy and coalition building, starting with the premise "If you want broadband, you gotta get it built." The panel will get to the heart of the challenge of this necessary paradigm change: moving municipalities, non-wireless industry advocates, citizens, carriers and DAS providers onto the same page.

Law Seminars International presents Cloud Computing: Law, Risks and Opportunities

On December 13-14, 2010, Law Seminars International presented a seminar exploring different cloud computing service models and the challenges they pose. They explored what cloud computing is, how it works and the benefits it offers.

Leading practitioners, including Dan Royalty (K&L Gates Seattle), described the contracting and compliance challenges their clients face on a daily basis and shared their strategies for meeting them.  Among other things, the program provided pointers on identifying the legal and compliance issues around cloud computing and addressing them in cloud computing transactions.
